The User shall be deemed to have accepted and agreed to the following terms and conditions upon the Users usage of the website www.onbyz.com, Mobile Apps or any of the SaaS products/platforms owned by Onbyz

1. 1. The term Onbyz shall mean Onbyzintl Technologies Pvt Ltd. and the term User shall mean the user who is browsing the website www.onbyz.com (Site).
   2. By using the Site/Mobile Apps/SaaS Platforms, User agrees to follow and be bound by the following terms and conditions and these terms and conditions may be revised or modified at any time by Onbyz  without any notice to User.
   3. www.onbyz.com is owned by Onbyz. All content present on this Site is the exclusive property of Onbyzintl Technologies Pvt Ltd including all the software, text, images, graphics, video and audio used on this Site.
   4. Onbyz  name and logo are trademarks which belong to and are owned by Onbyzintl Technologies Pvt Ltd. These trademarks may not be used in any manner without prior written consent from Onbyz.
   5. No material from this site may be copied, modified, reproduced, republished, uploaded, transmitted, posted or distributed in any form without prior written permission from Onbyz. All rights not expressly granted herein are reserved.
   6. Unauthorized use of the materials appearing on this Site may violate copyright, trademark and other applicable laws, and could result in criminal or civil penalties. Onbyz may monitor access to the Site.
   7. Onbyz  may terminate User’s access to the Site/Mobile Apps/SaaS Platforms at any time for any reason. The provisions regarding disclaimer of warranty, accuracy of information, and indemnification shall survive such termination.
   8. Onbyz  makes no warranties, express or implied, including, without limitation, those of merchantability and fitness for a particular purpose, with respect to any information, data, statements or products made available on the Site/Mobile Apps/SaaS Platforms.
   9. The Site, and all content, materials, information, software, products and services provided on the Site, are provided on an “as is” and “as available” basis.
   10. Onbyz  shall have no responsibility for any damage to User’s computer system or loss of data that results from the download of any content, materials, information from the Site/Mobile Apps/SaaS Platforms.
   11. Onbyz  may unilaterally change or discontinue any aspect of the Site/Mobile Apps/SaaS Platforms at any time, including, its content or features.
   12. Onbyz will not be liable for damages of any kind, including without limitation, direct, incidental or consequential damages (including, but not limited to, damages for lost profits, business interruption and loss of programs or information) arising out of the use of or inability to use the Site/Mobile Apps/SaaS Platforms, or any information provided on the Site/Mobile Apps/SaaS Platforms, or for any other reason whatsoever.
   13. User agrees to indemnify, defend and hold Onbyz  harmless from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, arising out of or relating to any misuse by the User of the content and services provided on the Site/Mobile Apps/SaaS Platforms.
   14. The information contained in the Site has been obtained from sources believed to be reliable. Onbyz  disclaims all warranties as to the accuracy, completeness or adequacy of such information.
   15. The Site provides links to web sites and access to content, products and services from third parties, including users, advertisers, affiliates and sponsors of the Site. User agrees that Onbyz is not responsible for the availability of, and content provided on, third party web sites. The User is requested to peruse the policies posted by other web sites regarding privacy and other topics before use. Onbyz is not responsible for third party content accessible through the Site, including opinions, advice, statements and advertisements, and User shall bear all risks associated with the use of such content. Onbyz is not responsible for any loss or damage of any sort User may incur from dealing with any third party.
   16. Onbyz  makes no warranty that: (a) the Site will meet your requirements; (b) the Site will be available on an uninterrupted, timely, secure, or error-free basis; (c) the results that may be obtained from the use of the Site or any services offered through the Site will be accurate or reliable.

SaaS Platform – Servv 

1. 1. Servv (https://servv-client.web.app/) is a web-based SaaS platform owned and developed by Onbyz, specifically designed for real estate developers and facility management companies to service their customers.
   2. The mobile apps connected to the Servv  will have different app names based on the customer that signs up with Onbyz.
   3. These apps will be uploaded to the Play Store (https://play.google.com/store/apps/developer?id=Onbyz&hl=en) and App Store (https://apps.apple.com/us/developer/onbyzintl-technologies-private-limited/id1130504428) accounts owned by Onbyz, and all such products are owned by Onbyz.
   4. Customers will only receive a license under a subscription fee on a monthly or annual basis, even if the mobile apps are branded with the respective names of the customers.

SaaS Platform Pricing Policy 

The pricing for services rendered through our SaaS platform is determined based on specific maintenance requests rather than a flat rate. The real estate developer or facility management company establishes the pricing according to the nature of the service they provide to their customers. After an inspection by an authorized representative from the real estate developer or facility management company, a detailed estimate is sent to the end user for approval. Although the final billing may differ from the initial estimate due to additional work, any changes will be clearly communicated to the end user. Payments will be processed only with the end user’s complete knowledge and approval, ensuring transparency and fairness.

Additionally, the platform collects annual or monthly subscription fees from real estate developers or facility management companies for using the SaaS platform to service their customers.

Subscription Fees:

• • Monthly or annual subscription fees for real estate developers and facility management companies based on the number of units managed and the features required.

Transaction Fees:

• • A percentage-based fee on each payment transaction processed through the Onbyz payment gateway.

Custom Features:

• • Additional charges for custom features or integrations requested by clients.

Payment and Refund Policy 

1. 1. The company integrates payment gateways within its Software as a Service (SaaS) products/website to facilitate the collection of service fee/subscription fees on a monthly or yearly basis, and to process payments from end users on behalf of Onbyz’s SaaS product customers.
   2. Payments Made via SaaS Platform: When using the SaaS product developed by Onbyz for servicing their customers, the real estate developer or facility management company agrees to authorize Onbyz to collect payments from end users for services rendered by these companies.
   3. Onbyz collects annual or monthly subscription fees from real estate developers or facility management companies for using the SaaS platform to service their customers. Subscription fees are based on the number of units managed and the features required, with options for monthly or annual billing. Transaction fees apply as a percentage of each payment transaction processed through the Onbyz payment gateway.
   4. Subscription Fee Refund: The company does not offer refunds for payments made for any SaaS product, regardless of whether the customer is national or international. Subscription fees are collected only after services have been rendered, and once a payment is completed, it is considered final and non-refundable.
   5. Refunds for services rendered through the SaaS platform: Refund will not be issued, as payments are processed based on the approved estimate and the corresponding invoice amount generated by the real estate developer or facility management company. The final invoice may differ from the initial estimate if additional services are provided during the servicing process. Refunds will not be provided under any circumstances, as the customer is fully informed of the transaction. Payments are collected and settled with the real estate developer or facility management company only after the successful completion of services and receipt of customer rating.

Cancellation Policy (For payments collected via SaaS Product)

1. 1. End users can cancel maintenance requests at any time before the service is initiated without any penalty.
   2. If the cancellation occurs after the service has started, end users will be billed for the work completed up to the point of cancellation.
   3. Cancellation requests must be channelled to the real estate developer or facility management companies via the channels they support.
   4. Invoicing for any initiated and cancelled work will be based on the agreement reached by the end user and the real estate developer or facility management company.

Cancellation Policy (For SaaS Platform Subscription)

1. 1. Real estate developers or facility management companies may stop using the SaaS product at any time they wish.
   2. Cancellation requests must be sent to or notify Onbyz by emailing onbyz@onbyz.com from an authorized person at the real estate development company or facility management company.
   3. Subscription fees for the SaaS product up to the date of cancellation will be collected based on usage till that date.

By using our products/services and making payments for our SaaS products, you agree to abide by these policies. These policies are subject to change, and it is the user’s responsibility to periodically check and review this policy.
